In the German intellectual context, the answer to this question could be as laconic (...) as it would be superfluous: it consists in a deictic reference to the name and, implicitly, to the work of Niklas Luhmann. American readers, in contrast, may need some introductory explanation in order to understand the epistemological triangle between contemporary pedagogical thought, Maturana's biology, and Luhmann's philosophy—and, above all, in order to assess and even to appreciate its intellectual potential.Niklas Luhmann is certainly difficult to read, at least for starters, and to those who met him during his lifetime he invariably appeared to be a dead-serious person. But today, more than five years after Luhmann's death, we begin to discover traces of a sometimes uncanny irony—one may want to call it a "practical irony"—in his writing. One of the discursive gestures that characterized Luhmann's texts were references to academic authors who nobody had ever heard of (let alone read), presented with the same seriousness and with the same attitude of intellectual reverence that we normally reserve for the classics: for example, to the logician Gotthart Guenter, the philosopher Fritz Heider, the biologist Humberto Maturana, or the mathematician George Spencer Brown. There is no doubt that, in each case, a specific concept or a specific thought developed by one of these authors had turned out to be truly important within Luhmann's own work, and yet the "effects of authority" that his very serious quotes produced were nothing short of hilarious. For Luhmann's readers, with that self-flagellating attitude in which we academics so like to indulge, quite regularly attributed the experience that they had never heard of those seeming "authorities" to their own lack of intellectual cosmopolitanism. This is why, until the present day, some departments of sociology or philosophy in Germany have Spencer Brown or Guenter specialists on their payrolls, and this also explains why some of those authors have had moments of intense reception [End Page 22] in the world of the humanities and social sciences at German universities. Among them, Humberto Maturana, together with his co-author the late Francisco Varela, seem to be the exception confirming the rule that none of those Luhmann references had the intellectual power to survive Luhmann himself.Now why should one trust Luhmann's trust in Maturana? The debate about the importance of Luhmann's thought (he labeled it a "theory of social systems") in the larger context of contemporary Western philosophy has barely begun to become serious, and we are certainly many years away from a definitive consensual evaluation. But there are two—very different—features about Luhmann's work that make him fascinating at first glance. One lies in the simple fact that, probably, no other thinker since Hegel has managed to develop a restrained set of basic concepts and premises into a systematically coherent philosophical edifice of similar proportions. In this sense, entering the dimension of Luhmann's thought offers the patient reader a possibility to view many familiar positions and questions from sometimes radically different innovative angles. Less obvious, however, and more intriguing is Luhmann's intellectual bet to develop his systemic thought under strict avoidance of notions such as "subject," "subjecthood," or "agency." It was this very bet (about whose existential and political motivations he only left some rather vague remarks) that explains Luhmann's fascination for much theoretical thinking emerging from biological research, above all for Humberto Maturana's work. For from a biological perspective, subjecthood and agency are highly marginal attributes in the realm of living organisms. I believe that this (almost hidden) component in Luhmann's thinking can explain the particularly strong affinity of contemporary pedagogical thought in Germany with his work. Some of the recent criticisms published during and after the last revision process of the Declaration of Helsinki are directed at its basic legitimacy. In this article we want to have a closer look at the two criticisms we consider to be the most fundamental. The first criticism questions the legitimate authorship of the World Medical Association to publish a document such as the Declaration. The second fundamental criticism we want to examine argues that the last revision process failed to (...) meet the standards for fair, democratic procedures. Although both criticisms deny the formal legitimacy of the Declaration in the most fundamental way, they have never been addressed in detail in a single article. We refute most of the related arguments. However, acknowledging some of the points made, improvements for future revision processes and versions of the Declaration of Helsinki are outlined. (shrink)

This chapter investigates the idea of collective epistemic commonality suggested by Charles Taylor's example, and contrasts it with a distributive notion of epistemic commonality. It describes a number of accounts of collective epistemic commonality, and then argues that, contrary to what Taylor suggests, conversation is not constitutive of collective epistemic commonality as such, but rather presupposes basic forms of collective epistemic commonality. Taylor's remarks indicate that understanding the consensus is insufficient as whatever proposition people rationally and openly accept in conversation. (...) It is suggested that joint attitudes are irreducible, relational, and pre-reflective, and that such attitudes are joint, in the respect that the participants are aware of themselves as a ‘we’. This essay attempts to give definitions and identity conditions for the two predominant senses of ‘Argument’ currently in use, the one involving reasons for a conclusion and the other denoting an expressed disagreement with ensuing verbal behaviour by two parties. I see Johnson's new concept of ‘Argument’, as developed in his book Manifest Rationality, as a hybrid of the two common senses of ‘Argument’, and, accordingly, I try to define and give the identity conditions of Johnson-arguments. Finally, I disagree with (...) Johnson on the nature of the definition he thinks he has proposed, and I conclude with observations suggesting that his logical perspective has dialectical and rhetorical components. (shrink)

In many countries patient involvement is high on the healthcare policy agenda, which includes patient representation in collective decision-making. Patient organizations are generally considered to be important representatives of patients. Other actors also claim to represent patients in decision-making, such as politicians, healthcare professionals, and client advisory councils. In this paper we take a broad view of patient representation, examining all the actors claiming to represent patients in the Dutch debate on the decentralization of care. We conclude that variety in (...) forms of representation could help do justice to the variety of patient preferences. In addition we conclude that in order to ensure the democratic quality of patient representation, actors making representative claims have to reflect on how their claims relate to each other and how they can ensure authorization and accountability in the representative relationship with those they claim to represent. With the ‘practical turn’ in studying the sciences and their history, this has begun to change. This paper is concerned with systems and cultures of experimentation and the consistencies that are generated within such systems and cultures. The first part of the paper exposes the forms (...) of historical and structural coherence that characterize the experimental exploration of epistemic objects. In the second part, a particular experimental culture in the life sciences is briefly described as an example. La obra de Hans-Dieter Gondek y László Tengelyi, Neue Phänomenologie in Frankreich (2011) ofrece una relectura de los nuevos desarrollos fenomenológicos provenientes de Francia. Su tesis principal es que a pesar de que estos enfoques son muy diversos, ellos tienen en común el siguiente motivo fundamental: una reformulación del estatuto del fenómeno como «acontecimiento de sentido» (Sinnereignis). El presente trabajo ofrece una traducción al español de la «Introducción» de la obra mencionada, donde se expone un panorama general de la (...) filosofía francesa. En segundo lugar, se aborda la lectura de Dominique Janicaud del supuesto «giro teológico» en cierto sector la fenomenología gala, que juzgan parcial e insuficiente para dar cuenta de la nueva fenomenología en el Hexágono. Finalmente, tratan de probar las limitaciones de la lectura de Janicaud, contraponiendo dos perspectivas fenomenológicas, a su juicio, sumamente distintas, a saber: Jean-Luc Marion y Marc Richir. Aunque estas propuestas tengan metas diferentes, ellas llevan adelante una transformación de los límites de la fenomenicidad, un tópico que también está en el centro mismo de los análisis de los autores. In this essay, the relation between art and religion is explored using the concepts experience and imagination as understood by the American philosopher John Dewey. In Dewey’s view, experience involves both the experiencer and the experienced: it is a phenomenon of the in-between. When we are really touched by what we meet in interacting with our physical and social surroundings, experience acquires an aesthetic quality that opens us to the value and the potential of what we perceive. We can see (...) the factual in light of the possible, thus enriching it with new layers of meaning. We experience this as resonance between us and the world. It is the work of the imagination. Due to their imaginative capacity, humans can aspire to a ‘good life’. This aspiration is discussed in terms of invitation and response. Can we experience ourselves as being invited to respond to this unruly world with attachment and care? Here art and religion come into play. Art is understood as the domain of the possible: it explores the world behind or beyond what we usually accept as fact. An aesthetic experience acquires religious quality when it evokes in us an ideal that guides our sense of self and world, stimulating us to realize our ideals in daily actions. If inspired by imagination, art and religion may evoke intense experiences of resonance and invite us to new ways of connecting and transformative action. This is explored with the help of a hermeneutical circle, a ‘cycle of imagination’. (shrink)
